1.3. By using Clinics Abroad, you acknowledge and agree that our role is limited to providing information and access to clinics through listings, resources, and promotional content. We do not participate in, oversee, or manage any communications, arrangements, or services between you and a clinic. While we strive to ensure the information on our platform is accurate and current, we do not guarantee the quality, suitability, or success of any services offered by clinics.
2. Definitions
2.1. “Account” means a user-created profile that provides access to specific features or functionalities of the platform.
2.2. “Clinic” means any medical or healthcare service provider listed on the platform that offers treatments or consultations to users.
2.3. “Clinics Abroad” means Clinics Abroad, SIA, a company registered in Latvia under registration number 40203558470, providing the platform to connect users with clinics.
2.4. “Content” means all materials available on the platform and in our promotions, including but not limited to clinic listings, articles, interactive catalogues, video materials, and images.
2.5. “Dispute Resolution” means the process by which disagreements between users, clinics, and Clinics Abroad are handled, including mediation, arbitration, or legal proceedings.
2.6. “GDPR” means General Data Protection Regulation (EU Regulation 2016/679), which governs the collection, processing, and storage of personal data for users within the European Union.
2.7. “Governing Law” means the legal framework under which these Terms are interpreted and enforced, which is the law of Latvia unless otherwise stated.
2.8. “Inquiries” means requests submitted by users through the platform seeking information or quotes from clinics.
2.9. “Personal Data” means any information relating to an identified or identifiable individual, collected or processed by Clinics Abroad as part of the platform’s operation.

2.14. “Third-Party Processors” means external service providers, such as Stripe or WhatsApp Business, involved in processing payments, communications, or other data on behalf of Clinics Abroad.
2.15. “User” or “Patient” means any individual accessing or using the platform to inquire about or connect with clinics listed on the platform.
3. User Responsibilities
3.1. By accessing and using Clinics Abroad, you agree to adhere to the following responsibilities, which ensure a secure, fair, and efficient platform for all users:

4.6. Users are prohibited from uploading materials that infringe on third-party copyrights, trademarks, or other intellectual property rights.
4.7. Platform Integrity
4.8. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
4.9. Any unauthorized access to your account must be reported to Clinics Abroad immediately.

5. Failure to Comply

5.2. Clinics Abroad reserves the right to enforce these responsibilities at its sole discretion to protect the integrity and safety of the platform for all users.

6.1. Nature of the Service
6.2. Clinics Abroad provides an online platform accessible at www.clinicsabroad.com that connects Users with clinics offering affordable medical and healthcare services abroad. The platform allows users to:
6.2.1. Browse clinics and navigate to clinic websites, appointment pages, or email contacts through the platform’s dedicated links.
6.2.2. Browse clinic articles and navigate to clinic websites, appointment pages, or email contacts through the platform’s dedicated links.
6.2.3. Browse clinics through an interactive digital catalogue published on the platform, social media, and promotional materials, and navigate to clinic websites, appointment pages, or email contacts through the dedicated links.
6.2.4. Sign up to Clinics Abroad’s marketing updates, where users are notified twice a month about the latest clinics, procedures, prices, and the soonest availability of senior specialists within their opted clinic category.
6.2.5. Participate in Clinics Abroad’s quarterly promotional giveaways, where one subscriber every 3 months is randomly selected to receive a credit of 500 EUR, or its equivalent, to use at any of Clinics Abroad listed clinics.
6.3. Role of Clinics Abroad
6.4. Clinics Abroad provides a platform for users to discover, research, and connect directly with clinics through listings, resources, and promotional content. Clinics Abroad does not:
6.4.1. Provide medical advice, diagnosis, or treatment;
6.4.2. Endorse, verify, or guarantee the quality, suitability, or safety of the services provided by clinics;
6.4.3. Participate in or oversee any communications, agreements, transactions, or services between users and clinics. All such matters are the sole responsibility of the clinics;
6.4.4. Intervene in disputes between users and clinics. All communications, agreements, and services rendered beyond the platform are the sole responsibility of the clinics.
7. Availability of the Platform
7.1. Clinics Abroad strives to maintain the availability of its platform but does not guarantee uninterrupted access. Scheduled maintenance, technical issues, or factors beyond the company’s control may temporarily disrupt service. Clinics Abroad will provide advance notice for planned outages whenever feasible.
7.2. Changes to the Service
7.3. Clinics Abroad reserves the right to modify, update, or discontinue any part of the platform or its services at its sole discretion. Any significant changes will be communicated to users through the platform or email.
7.4. Limitations on Use
7.5. The platform and its services are intended for personal, non-commercial use. Users agree not to:

8.6. Sharing of Data with Clinics
8.7. Clinics Abroad does not share user personal data, including contact details or medical information, with any clinic. All clinic listings, articles, and catalogs published on the platform include direct links to the clinic’s own website or communication channels, enabling users to initiate contact at their discretion. Any information shared by the user with a clinic is done directly and independently of Clinics Abroad, and Clinics Abroad has no access to, involvement in, or responsibility for such exchanges.
8.8. Consent and Withdrawal
8.9. Users may withdraw their consent at any time by contacting Clinics Abroad at dpo@clinicsabroad.com.
8.10. Upon withdrawal of consent, Clinics Abroad will cease further processing of the data, except as required by law.

In this case, all subsequent communications, arrangements, or transactions—including inquiries, scheduling, and payments—occur directly between the user and the clinic without any further involvement from Clinics Abroad.
9.2. Responsibility and Liability
9.2.1. Clinics Abroad does not:
9.2.1.1. Monitor or intervene in communications between users and clinics.
9.2.1.2. Guarantee that clinics will respond to inquiries or provide quotes within a specific timeframe.
9.2.1.3. Bear responsibility for the quality, suitability, or outcomes of any medical services arranged between users and clinics.
9.2.2. All further communication, scheduling, and services are conducted directly between the user and the selected clinic. Clinics Abroad is not liable for any disputes arising from these interactions
9.3. User Responsibilities
9.4. Users are advised to:
9.4.1. Conduct due diligence on clinics, including verifying credentials, reviews, and accreditations.
9.4.2. Ensure all terms, costs, and conditions are clearly understood and agreed upon before proceeding with any services.
9.4.3. Contact the clinics directly to address any issues or disputes that may arise.
9.5. By using Clinics Abroad, users acknowledge and agree that the platform’s role is limited to providing information and direct links to clinics, enabling users to initiate contact at their own discretion. Clinics Abroad does not collect or share user data with clinics and has no involvement in, or responsibility for, any subsequent communications, agreements, or services between users and clinics.
9.6. Responsibility of Clinics
9.7. Clinics receiving inquiries are solely responsible for:
9.7.1. Providing accurate and truthful responses to user inquiries.
9.7.2. Offering clear and detailed information about their services, pricing, and any associated terms or conditions.
9.7.3. Adhering to relevant laws and medical standards in their jurisdiction.
9.8. User Responsibilities
9.9. Users are encouraged to:
9.9.1. Ensure that any information they choose to provide to clinics—whether via direct contact or other channels—is accurate, complete, and relevant to their inquiry.
9.9.2. Communicate directly with clinics for any additional details, clarifications, or arrangements relating to their services.
9.9.3. Conduct their own due diligence, including verifying the credentials, accreditations, and reviews of clinics, before entering into any formal agreements or committing to services.
9.10. Clinics Abroad does not guarantee that clinics will respond to all inquiries, nor does it bear responsibility for the quality, suitability, or outcomes of services provided by clinics. Any disputes or issues arising from interactions with clinics must be resolved directly with the clinic.
9.11. By using the Platform, you acknowledge and accept these terms, including the limitations of Clinics Abroad’s role as an intermediary.
9.12. Medical Information Disclaimer
9.13. The content provided on the Clinics Abroad platform, including but not limited to clinic listings, articles, interactive catalogues, and informational materials, is intended for general informational purposes only. While we strive to ensure accuracy and reliability, this content is not a substitute for professional medical advice, diagnosis, or treatment. Users should always consult a qualified healthcare provider for any medical concerns or decisions regarding their health.
9.14. Clinics Abroad does not endorse or guarantee the accuracy, applicability, or completeness of the information provided on the platform. Users are advised to verify the information with appropriate healthcare professionals or reliable sources before relying on it.
9.15. By accessing and using the informational content on the platform, you acknowledge that Clinics Abroad is not responsible for any outcomes resulting from the use or misuse of this information. All medical decisions should be made in consultation with licensed healthcare providers.
10. Governing Law and Dispute Resolution
10.1. These Terms and Conditions are governed by and construed in accordance with the laws of Latvia. Users agree that any disputes arising from or related to these Terms, the use of the platform, or the services provided will be subject to the following dispute resolution process:

10.3. In the first instance, all parties agree to make a genuine effort to resolve disputes amicably through good-faith negotiations. Users may initiate this process by contacting Clinics Abroad at dpo@clinicsabroad.com.
10.4. Mediation and Arbitration:
10.5. If a dispute cannot be resolved amicably within 30 days, it shall be referred to mediation or arbitration under the rules of the Latvian arbitration court.
10.5.1. The mediation or arbitration proceedings shall be conducted in English.
10.5.2. The venue for arbitration shall be Riga, Latvia, unless otherwise agreed by the parties.
10.5.3. The arbitrator’s decision shall be binding and enforceable in any court of competent jurisdiction.
10.6. Jurisdiction for Cross-Border Disputes:
10.7. For cross-border disputes, users agree that the governing law remains that of Latvia. Clinics Abroad makes no representation that the platform complies with laws of jurisdictions outside of Latvia. Users accessing the platform from other regions are responsible for ensuring compliance with local laws.
10.8. Exclusions
10.9. This clause does not limit users’ rights to bring claims in their local jurisdiction where mandatory consumer protection laws apply.
10.10. Modifications to the Terms
10.11. Clinics Abroad reserves the right to amend these Terms and Conditions at its sole discretion. Any changes will be communicated to users via email or through prominent notices on the platform. Changes will become effective immediately upon posting unless otherwise specified.

11. Acceptance of Terms

11.2. Acceptance of these Terms is indicated through affirmative action, such as checking a box or clicking “I agree” during the registration or inquiry process. Users who do not accept these Terms are prohibited from using the platform or its services.

Clinics Abroad, SIA, retains all rights, title, and interest in and to the platform, including but not limited to its design, functionality, content, trademarks, logos, and proprietary software. Users are granted a non-exclusive, non-transferable, and revocable license to access and use the platform solely for personal and non-commercial purposes, in accordance with these Terms and Conditions.

To the fullest extent permitted by applicable law, Clinics Abroad, SIA, and its officers, directors, employees, agents, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to the use of the platform or services provided by clinics, even if Clinics Abroad has been advised of the possibility of such damages.

13.3.2. Guarantee the accuracy, suitability, or quality of services provided by clinics.
13.3.3. Monitor or validate the medical outcomes or service levels of clinics.
13.4. Users acknowledge that Clinics Abroad is not liable for any claims, losses, or damages arising from:
13.4.1. Medical procedures, treatments, or consultations conducted by clinics.
13.4.2. Errors or inaccuracies in clinic information provided on the platform.
13.4.3. Delays, non-responses, or unsatisfactory service levels from clinics.
13.5. Data Accuracy and Responsibility
13.6. While Clinics Abroad strives to ensure accurate and up-to-date information on the platform, it does not warrant or guarantee:
13.6.1. The completeness, reliability, or accuracy of clinic listings or responses.
13.6.2. That clinics will respond to inquiries within a specific timeframe or at all.
13.7. Users are solely responsible for verifying the credentials, qualifications, and reputation of clinics before engaging their services. Clinics Abroad disclaims all liability for user reliance on information provided on the platform.
13.8. User Responsibilities
13.9. Users must:
13.9.1. Conduct their own due diligence before proceeding with any medical service.
13.9.2. Understand and agree that all services, consultations, and medical treatments are undertaken at their own risk.
13.10. Clinics Abroad is not liable for any disputes, claims, or damages arising between users and clinics. Users are advised to resolve such matters directly with the respective clinic.
13.11. Service Interruptions and Technical Issues
13.12. Clinics Abroad is not liable for:
13.12.1. Temporary unavailability of the platform due to technical issues, maintenance, or unforeseen circumstances.
13.12.2. Loss of data, delayed responses, or errors resulting from user misuse, system failures, or third-party service providers.
13.13. Liability Cap
13.14. Clinics Abroad’s total liability for any claim arising out of or related to the platform, whether in contract, tort, or otherwise, shall not exceed the amount paid by the user to Clinics Abroad for services in the 12 months preceding the claim.
13.15. Exclusions
13.16. Nothing in this clause excludes or limits liability for:
13.16.1. Gross negligence or willful misconduct by Clinics Abroad.
13.16.2. Any liability that cannot be excluded under applicable law.
